By accessing or using Pitch & Purchase (“the Platform”), you agree to be bound by these Terms of Service. If you do not agree with these terms, you must not use the Platform.

Nature of the Platform

Pitch & Purchase is a technology platform that allows independent users to present products or services through videos, listings, and live streams.

The Platform only provides the digital tools that allow users to showcase products and connect with buyers.

Pitch & Purchase is not a retailer, merchant, broker, auctioneer, or payment processor.

Marketplace Intermediary Clause

Pitch & Purchase acts solely as a software and hosting platform.

All transactions occur directly between buyers and sellers using payment methods chosen by the seller.

Pitch & Purchase:

• Does not process payments
• Does not hold funds
• Does not act as an escrow service
• Does not guarantee transactions
• Is not a party to any purchase agreement

Any purchase made through a seller's payment link is a direct transaction between the buyer and the seller.

Pitch & Purchase has no involvement in payment processing, order fulfillment, shipping, refunds, or disputes.

Seller Responsibility

Sellers are fully responsible for:

• All products they list
• Product descriptions and accuracy
• Pricing
• Shipping and delivery
• Customer service
• Refunds and returns
• Compliance with applicable laws

Pitch & Purchase does not verify the accuracy or legality of seller listings.

Buyer Responsibility

Buyers are responsible for evaluating sellers before making a purchase.

Any purchase made through a seller's payment link is a direct agreement between the buyer and the seller.

Pitch & Purchase does not guarantee seller reliability, product quality, delivery, or transaction outcomes.

Payment Disclaimer

Payments are processed by third-party payment providers chosen by the seller, such as Stripe, PayPal, Venmo, or other services.

Pitch & Purchase does not store, process, or manage payment information.

All payment disputes must be resolved between the buyer, seller, and the payment provider.

Fraud Monitoring

Pitch & Purchase actively monitors the platform for suspicious or fraudulent activity.

We reserve the right to:

• Investigate suspicious accounts
• Remove listings
• Suspend or terminate accounts
• Ban users who violate these Terms

However, monitoring does not guarantee that all fraudulent activity will be detected or prevented. Users engage in transactions at their own risk.

Prohibited Activities

Users may not use the platform to:

• Sell illegal goods or services
• Commit fraud or deception
• Misrepresent products
• Upload harmful software or malicious content
• Violate intellectual property rights

Violation of these rules may result in immediate account termination.

User Content

Users retain ownership of the content they upload including videos, images, and product descriptions.

By uploading content, users grant Pitch & Purchase a non-exclusive license to display and distribute the content within the platform for the purpose of operating the service.

Platform Availability

Pitch & Purchase may update, modify, suspend, or discontinue the platform at any time without notice.

We do not guarantee uninterrupted access or error-free operation.

Limitation of Liability

To the maximum extent permitted by law, Pitch & Purchase and its operators are not liable for:

• Transactions between users
• Product quality or delivery issues
• Payment disputes
• Refund disagreements
• Losses caused by fraudulent sellers
• Indirect or consequential damages

Users assume all risks associated with transactions conducted through seller payment links.

Indemnification

Users agree to indemnify and hold harmless Pitch & Purchase from any claims, damages, losses, or legal disputes arising from their use of the platform or their transactions with other users.

Account Suspension

Pitch & Purchase reserves the right to suspend or permanently terminate accounts that violate these Terms or engage in suspicious activity.

Changes to These Terms

We may update these Terms of Service from time to time. Changes will be posted on this page.
